Jammu, September 8: A Jammu court has directed the registration of an FIR against Deputy Superintendent of Police (DSP) Sunil Jasrotia over allegations of assault and misconduct involving Jammu and Kashmir Administrative Service (JKAS) officer Azhar Khan during election-related duties in November 2025.
City Judge and Judicial Magistrate First Class Jammu Ghulam Murtaza passed the order on September 5, directing the Senior Superintendent of Police (SSP) Jammu to ensure registration of the case against Jasrotia and take appropriate action against the then officer in charge of Police Station Gandhi Nagar for allegedly failing to register Khan’s complaint.
According to the court proceedings, Khan, who is currently posted as Block Development Officer (BDO), Nagrota, approached the court seeking directions for registration of an FIR against Jasrotia and other police personnel over an incident that allegedly occurred on November 10, 2025.
At the time, Jasrotia was serving as SDPO City South Jammu. Khan alleged that he was assaulted, restrained and subjected to misconduct by police personnel, including the then SDPO and his personal security officers, while he was performing election-related duties.
Khan had initially approached Police Station Gandhi Nagar, but alleged that despite his complaint disclosing cognisable offences, no FIR was registered. He subsequently moved the court under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
While examining the matter, the court considered material collected during a preliminary inquiry, including statements from independent witnesses and CCTV footage related to the alleged incident.
The court observed that the material warranted a formal investigation and accordingly directed the registration of an FIR in accordance with law.
The court also took note of the alleged failure by the Gandhi Nagar police station to register the complaint and directed SSP Jammu to take appropriate action against the officer responsible.
To ensure an impartial investigation, the court ordered that the probe be conducted fairly by a police officer of the rank of Deputy Superintendent of Police or above who has no connection with the incident.
The court referred to the statutory provisions governing the registration of information relating to cognisable offences, as well as legal principles laid down by the Supreme Court concerning FIR registration when such offences are disclosed.
The allegations against Sunil Jasrotia and the other police personnel named in the complaint will now be investigated. The court’s direction to register an FIR does not amount to a finding of guilt against the police officer or any other person accused in the matter.
The application was accordingly disposed of with directions for registration of the case, appropriate action against the concerned police station officer and an independent investigation.
